This ShoppingGives Shopper Privacy Policy ("Shopper Policy") explains how Niche Interactive Media Inc. d/b/a ShoppingGives ("ShoppingGives," "we," or "us") collects, uses, and discloses information about consumers or “shoppers.” This Shopper Policy applies to information we collect when you access or use our website and other online products and services as a shopper, including when you make a donation through one of our partners, use the ShoppingGives “Shopper” portal, or visit a ShoppingGives website (collectively, the "Shopper Services"), or when you otherwise interact with us as a shopper, such as through our customer support channels, or on social media pages. We may provide different or additional notices of our privacy practices with respect to certain products or services, in which case this Shopper Policy will not apply. 


This Shopper Policy does not apply to data that is collected, used, or disclosed when you use ShoppingGives’ software-as-a-service technology platform as a merchant (“Merchant”) or charitable organization (“Charity”) or other analytics, advertising and related services we offer to Merchants and Charities (collectively, “Enterprise Services” and, together with “Shopper Services,” the “Services”). For information about our privacy practices when you use Enterprise Services, please see the ShoppingGives Enterprise Privacy Policy. Additionally, this Shopper Policy does not apply to the privacy practices of websites linked from the Shopper Services or of Merchants and Charities with whom you may interact. ShoppingGives is not responsible for the privacy practices of these other entities, and we encourage you to read their privacy policies.


We may change this Shopper Policy from time to time, in which case we will notify you by revising the date at the top of the policy. If we make material changes, we may provide you with additional notice (such as by adding a statement to the Shopper Services or sending you a notification). We encourage you to review this policy regularly to stay informed about our information practices and the choices available to you.

COLLECTION OF PERSONAL INFORMATION

The categories of personal information we collect and the sources from which we collect it depend on your interactions with us and are described in more detail below.

PERSONAL INFORMATION YOU PROVIDE DIRECTLY TO US

We collect personal information directly from you, including when you make a purchase through a Merchant’s website, online service or in-person point of sale system (each, a “Merchant Store”); create an online account and profile through the Shopper Services; subscribe to receive our emails or inquire about Shopper Services; place an order or make a return from our website; contact us to request assistance or provide feedback, including correspondence with customer service; participate in a marketing survey, promotion, or event; and interact with us on social media, including by posting content and tagging us. The types of personal information we collect directly from you may include your name, email address, postal address, account information (such as account password and username), your donation preferences (such as when you set your favorite cause/s) and any other information you choose to provide.

If you make a donation or purchase using our platform, we work with a third-party payment processor to collect and process your payment information.

PERSONAL INFORMATION WE COLLECT AUTOMATICALLY

We automatically collect personal information when you access and use the Shopper Services, including:

  • Device and Usage Information: We collect information about how you access and use our Services, including device information, such as your browser type, hardware model, operating system version, IP address, unique device identifiers, and language settings. We also collect information about your activity on the Shopper Services, such as your access times, pages viewed, search results, the routes by which you access the Shopper Services, and your use of any hyperlinks available within the Shopper Services.
  • Transaction Information: When you make a purchase or a donation on the Shopper Services, we collect information about the transaction, including products you purchased, the purchase and donation price, and the date and location of the transaction.
  • Information collected via cookies, web beacons, and other tracking technologies: We (and those that perform work for us) use cookies, web beacons, and other tracking technologies to collect information about your browsing behavior, purchase behavior, and other engagement with our Shopper Services. Cookies are small data files stored on your hard drive or in device memory that help us improve our Services and your experience, see which areas and features of the Shopper Services are popular, and count visits. Web beacons (also known as “pixel tags” or “clear GIFs”) are electronic images that we use on the Shopper Services and in our emails to help deliver cookies, count visits, and understand usage and campaign effectiveness. See the "Targeted Advertising and Analytics" and "Your Rights and Choices" sections below for further information.


We collect personal information automatically via ShoppingGives’ platform integration with Merchant Stores, including:


  • Device and Usage Information: We collect information about (i) how you access and use the Merchant Store, including device information, such as your browser type, hardware model, operating system version, IP address, unique device identifiers, and language settings; and (ii) your online activity on the Merchant Store, such as your access times, pages viewed, the routes by which you access the Merchant Store, products added to cart, and discounts used and if you completed your checkout experience.
  • Transaction Information: We collect information about your transactions on the Merchant Store, including products or services you purchased from the Merchant, donations made in connection with purchases, the purchase price and donation amount, and the date and location of the transaction.


ADDITIONAL PERSONAL INFORMATION WE COLLECT FROM OTHER SOURCES

We may collect additional personal information about you from other sources. For example, we may collect historical information from Merchants and Charities about your past transactions and behavior, which may include the same Device and Usage Information and Transaction Information described above, as well as email address associated with the transactions.

PERSONAL INFORMATION WE DERIVE

We may derive information or draw inferences about you based on the information we collect. For example, we may infer that you are interested in donating to certain types of charities based on your purchasing behavior in connection with the Shopper Services or Merchant Stores.

USE OF PERSONAL INFORMATION

We process information to provide, maintain, and improve the Shopper Services as well as our Enterprise Services, which includes: facilitating your donations to Charities; generating insights and analysis about shopper behavior for Charities and Merchants; and using information we learn about your donation and purchasing affinities to promote partnership opportunities between Charities and Merchants. We also use personal information to:

  • Communicate with you about products, services, contests, promotions, and other information offered by ShoppingGives and others that we think will interest you, unless you have opted out of such communications (see "Opting Out of Marketing Communications" for more information);
  • Identify, report, and repair errors that impair the functionality of the Services;
  • Analyze trends and statistics, learn more about your shopping preferences and your interaction with the Shopper Services, and improve your shopping experience;
  • Target and deliver advertising to you (see "Opting Out of Targeted Advertising, Sharing, and Sales" for information about how to opt out of targeted advertising);
  • Detect, investigate, and prevent security incidents and protect against malicious, deceptive, fraudulent, or illegal activity;
  • Respond to your comments, questions, and requests and provide customer service;
  • Personalize and improve the Shopper Services and provide content or features that match your profile and interests; and
  • Comply with our legal and financial obligations.

TARGETED ADVERTISING AND ANALYTICS

We process information both on our behalf and on behalf of Merchants and Charities for purposes related to targeting, delivering, measuring, and reporting on advertising. To do this, we and our partners may use cookies, web beacons, SDKs, device identifiers and other technologies to collect information about your use of the Services and other websites and applications, including your IP address and other identifiers, web browser and mobile network information, pages viewed, time spent on pages or in apps, links clicked, and conversion information. This information is used to deliver advertising targeted to your interests on other companies’ sites or mobile apps and to analyze and track data including to understand how our ads perform and determine the popularity of certain content, and better understand your online activity. You can turn off cookies used for ad targeting purposes by clicking the “Cookie Preferences” link found in the footer of our website. 


In addition, we and our advertising partners may translate your email address or phone number into an identifier that can’t be used to identify you personally. We or our advertising partners then use that unique identifier to show ads that are more relevant to you across the web and in mobile apps. 


Some of the activities described in this section may constitute “targeted advertising,” “sharing,” or “selling” under certain state privacy laws. See “Your Rights and Choices” and “Additional Information for California Shoppers” for more information and the privacy rights available to residents of certain U.S. states.

DISCLOSURES OF PERSONAL INFORMATION

We may disclose the categories of personal information described in "Collection of Personal Information" above in the following circumstances or as otherwise described in this Shopper Policy:

  • Merchants and Charities. We may disclose your information to Merchants and Charities with whom you interact for the purposes described in the "Use of Personal Information" section above.
  • Vendors and Service Providers. We make personal information available to our vendors, service providers, and contractors who perform services on our behalf, such as companies that assist us with web hosting, shipping and delivery, fraud prevention, customer service, surveys, payment processing, analytics, and marketing and advertising.
  • Corporate Transactions. Personal information may be disclosed or transferred as part of, or during negotiations of any purchase, sale, lease, merger, amalgamation or any other type of acquisition, disposal, securitization, or financing involving ShoppingGives.
  • Professional Advisors. We disclose personal information to our legal, financial, insurance, and other advisors in connection with the kinds of corporate transactions described above or in connection with the management of ShoppingGives’ business or operations.
  • Corporate Affiliates. We may disclose personal information to subsidiaries and corporate affiliates for the purposes described in the "Use of Personal Information" section above.
  • Law Enforcement Authorities and Individuals Involved in Legal Proceedings. We may disclose personal information about you, if necessary, in our good faith judgment, to comply with laws or regulations or in response to a valid subpoena, order, or government request, or to protect the rights, property, or safety of ShoppingGives or others.
  • Consent. We make personal information available to third parties when we have your consent or you intentionally direct us to do so. 

We also disclose aggregated or de-identified information that cannot reasonably be used to identify you. ShoppingGives processes, maintains, and uses this information only in a de-identified fashion and will not attempt to re-identify such information, except as permitted by law.

HOW LONG WE RETAIN THE INFORMATION WE COLLECT

We retain personal information for as long as necessary to carry out the purposes for which we originally collected it and for other purposes described in this Shopper Policy. The precise periods for which we keep personal information vary depending on the nature of the information and why we need it. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use and/or disclosure of the personal information, the purposes for which we process the personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

YOUR RIGHTS AND CHOICES

Updating Your Account Information

You can review and modify your online account information at any time. To access your online Shopper account, simply click "My Profile" at the top of shoppinggives.com and enter the “Shopper Portal” when prompted. 


Cookies and Similar Tracking Technologies

Most web browsers are set to accept cookies by default. If you prefer, you can usually adjust your browser settings to remove or reject browser cookies. Please note that removing or rejecting cookies could affect the availability and functionality of the Shopper Services. 


Opting Out of Marketing Communications

If you would like to stop receiving promotional emails from us, you may do so by clicking the unsubscribe link provided at the bottom of any ShoppingGives promotional email. If you opt out, we may still send you non-promotional messages, such as those about your account or our ongoing business relations.


Opt Out of Sales, Sharing, Targeted Advertising

Some of the activities described in the “Use of Personal Information” and “Targeted Advertising and Analytics” sections above may be considered “sales” or “sharing” of your personal information or use of your information for “targeted advertising” under the law that applies to you and you may* have the right to opt out of these activities. You or your authorized agent may opt out of these activities by following the prompts here.

Access, Correction, and Deletion

Depending on where you live, you may* have the right to (1) request to know more about and access your personal information, including in a portable format, (2) request deletion of your personal information, and (3) request correction of inaccurate personal information. To request access, deletion, or correction of your personal information, please fill out our webform. You may also email dataprotection@shoppinggives.com to submit a request. We may verify your request by asking you to provide certain information, such as related to your recent interactions with us. 


Appeals

If we deny a request to act on a legally-authorized right, you may have the right to appeal our decision by contacting us at dataprotection@shoppinggives.com. If you have concerns about the result of an appeal, you may contact the attorney general in the state where you reside.

We generally do not collect information that is considered “sensitive” under California law. In the limited circumstances that we do, such as collection of your account username and password, we do not use or disclose sensitive personal information for the purpose of inferring characteristics about you. 


Privacy Rights


If you are a resident of California, you have the right to request access to or correction of your personal information. You may exercise these rights using the information above. If you are submitting a rights request as an authorized agent, you are required to submit proof of your authorization to make the request, such as a valid power of attorney or proof that you have signed permission from the individual who is the subject of the request. Please do not provide any sensitive personal information in connection with this request, such as a driver's license or other government-issued ID. In some cases, we may contact the individual who is the subject of the request to verify their own identity or confirm you have permission to submit this request.

You may also opt out of any “sales” or sharing of your information by following the prompts here, or by visiting our Services with a legally recognized opt-out preference signal enabled, such as the Global Privacy Control. Note that we do not honor Do Not Track signals. We do not knowingly sell or share personal information about consumers under the age of 16. We will not discriminate against you for exercising your rights.
